3. Purpose of Processing Personal Data

Personal data may be processed for the following purposes:

  • Marketing activities relating to Berner, its group companies, and the brands they represent, including communication and announcements across different channels

4. Legal Basis for Processing

Processing is primarily based on the data subject’s consent, such as electronic direct marketing consent. A data subject may, for example, subscribe to newsletters or participate in competitions, in which case they give consent to the processing of their personal data. Consent can be withdrawn at any time via the unsubscribe link in the message or by contacting the controller directly.

Berner may also process personal data based on legitimate interest, for example, for targeted marketing, personalisation of communications through analytics or profiling, maintaining and developing customer relationships, and for business planning and reporting. Profiling is not based on automated decision-making and does not have significant effects on the rights or freedoms of the data subject. Profiling may be used, for instance, to form marketing segments or to target messages based on participation history, communication data, or purchasing behaviour.

Special category data (e.g., dietary requirements or health information) are processed only with the explicit consent of the data subject and only to the extent necessary for the specific processing purpose.

5. Data Content

The register may include the following personal data:

  • First and last name
  • Postal address
  • Telephone number
  • Email address
  • Company name, Business ID, position, or title (in business marketing)
  • Information related to the customer relationship and marketing activities (e.g., event participation, newsletter subscription history, and clicked links)
  • IP address identifying the user’s device
  • Behavioural data collected via cookies, if consent has been given for website analytics tracking

The register may also contain the following special category or sensitive personal data:

  • Allergy or dietary information provided in connection with events (voluntary to provide)
  • Health-related information provided by the data subject for targeted marketing or other specific purposes

6. Recipients and Recipient Groups

Personal data may be disclosed to:

  • Companies within the Berner Group engaged in joint marketing and promotional activities
  • Third-party service providers that offer Berner CRM, communication, analytics, marketing, or customer service-related services (e.g., email service providers, event organisers, data analytics services, and CRM system suppliers)
  • Authorities, when required by law or regulation

All data transfers and processing activities comply with applicable data protection legislation. Berner ensures secure and confidential processing through appropriate contractual arrangements.
No personal data are transferred outside the European Economic Area (EEA).

7. Retention Periods

Personal data are retained as long as necessary to fulfil the purposes described in this notice. Retention periods depend on the purpose of processing and any statutory obligations.

  • Personal data collected for newsletter subscriptions are retained until the subscription is cancelled or otherwise expires. Data are deleted no later than 12 months after termination of the subscription.
  • Data collected in connection with competitions and campaigns are retained for 12 months after the campaign or competition has ended.
  • Special category data are retained only for as long as necessary to fulfil the specific purpose of processing.

8. Sources of Data

Personal data are primarily collected directly from the data subject, for example, when subscribing to newsletters or participating in competitions. Data may also be collected from commercial registers or public sources.

9. Rights of the Data Subject

Data subjects have the right to:

  • Obtain confirmation as to whether their data are processed and access such data
  • Request rectification or erasure of their data
  • Object to direct marketing
  • Request restriction of processing or otherwise object to it
  • Data portability, where processing is based on consent and carried out automatically
  • Withdraw consent at any time
  • Lodge a complaint with the supervisory authority (in Finland: the Office of the Data Protection Ombudsman)

10. Principles of Data Protection

Data are stored in systems protected by technical and organisational measures, such as firewalls and passwords. Only authorised personnel have access to personal data. Appropriate confidentiality and data processing agreements are concluded with external service providers.
